Terms of Service

1. About these terms

BuildAI (https://buildai.alexcutrupi.com) is run by Alex Cutrupi, an individual based in the United Kingdom (“we”, “us”). You can contact us at alexcutrupi2022@gmail.com. Our Privacy Policy explains how we use your personal data.

If you’re a consumer, nothing in these terms affects your legal rights, including under the Consumer Rights Act 2015. BuildAI is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft.

2. Your account

• You must be 18 or over to create or use a BuildAI account.
• Give accurate details, and keep your email address up to date.
• Keep your password, and any API keys or server tokens, secret. You’re responsible for activity on your account and on servers linked to it. Tell us straight away if you think someone else has access.
• Accounts are personal. Don’t sell, share or transfer yours.

3. Accounts from hosting partners

Some Minecraft hosting companies are BuildAI partners and can create a BuildAI account for you when you buy a server from them. If yours did, these terms apply once you start using BuildAI (for example by setting a password or opening BuildAI from your host’s panel). Your host can:

• give you free perks, such as the plugin and credits, while your server with them is active;
• remove the plugin licence it gave you if your server with it is suspended or cancelled (credits you already have, and anything you bought yourself, stay yours); and
• log you in to BuildAI from its panel, but only for accounts it created.

Your agreement for your server is with your host. We’re not responsible for your host’s services.

4. The plugin licence

When you buy the BuildAI plugin (or are given it), we grant you a personal, non-exclusive, non-transferable licence to install and use it on Minecraft servers linked to your account, for as long as your licence is active. You must not:

• share, sell, rent or redistribute the plugin, or let others use it on servers not linked to your account;
• copy, modify, decompile or reverse engineer it, except as the law allows; or
• remove or bypass its licence, credit or security checks.

You must also follow the Minecraft End User Licence Agreement and usage guidelines when running your server.

5. Credits and builds

• Credits are prepaid units used to pay for builds. They have no cash value, can’t be exchanged for money or transferred to another account, and are only used within BuildAI.
• Credits don’t expire while your account is open.
• Skills from the skills marketplace are digital content. Free or paid, they’re added to your account straight away and stay while your account is open. We may improve or retire a skill; if we retire one, you keep using it.
• Each build is charged for the AI processing it actually uses, and never more than the maximum shown before the build starts. Builds on a linked server use the credits of the account that linked it.
• Builds are generated by AI. Results can vary, may not match what you asked for exactly, and may occasionally contain mistakes. Use the preview before placing a build.

6. Prices and payment

• Prices are shown on the site before you buy and include any VAT we charge. Prices outside the UK are converted from pounds sterling, and your bank may add its own fees.
• Payments are processed securely by Stripe. Your purchase is confirmed when payment succeeds.
• We may change prices for future purchases. Changes never affect purchases you’ve already made.
• If a price is clearly wrong because of an error, we may cancel the order and refund you in full.

7. Cancellations and refunds

Your 14-day right to cancel. If you’re a consumer, you normally have 14 days after buying digital content to cancel. The plugin and credits are supplied immediately. By buying, you ask us to supply them straight away, and you agree that you lose the right to cancel once supply has begun: when you download the plugin or link a server with it, or use any of the credits. Before that, you can cancel within 14 days for a full refund.

Faulty products. If the plugin or a build doesn’t work as described, you have legal rights to a repair, replacement or refund, and we’ll put things right.

How refunds work. To ask for a refund, email alexcutrupi2022@gmail.com from your account’s email address. Refunds go back to the original payment method. When a purchase is refunded, the credits it gave are removed from your balance (in proportion for partial refunds), and a full refund of the plugin ends its licence. If you’ve already spent refunded credits, we may take that into account.

Please contact us before disputing a payment with your bank, so we can try to sort it out quickly.

8. Your servers and content

• You’re responsible for the Minecraft servers you link, who can use BuildAI on them (through permissions) and what gets built.
• Back up your worlds. Builds change blocks in your world. We provide preview and undo, but we’re not responsible for changes you or your players choose to make.
• You own the prompts you write and the builds created for you, subject to the Minecraft EULA. You give us permission to process your prompts and builds as needed to run and improve BuildAI.

9. Acceptable use

You must not use BuildAI to:

• break the law, or create content that is illegal, hateful, sexually explicit involving minors, or that harasses others;
• infringe anyone else’s intellectual property;
• attack, overload, probe or disrupt our systems, or get around rate limits, credit charges or licence checks;
• scrape the site, or access our APIs except as documented; or
• resell access to BuildAI unless you’re an approved partner host acting within your partner terms.

10. Terms for partner hosts

If you’re an approved partner host, these extra terms apply:

• Keep your API keys secret, use them only from your own servers, and revoke any key that may have leaked.
• Only provision your own customers, with a lawful basis to share their email address with us, and tell them that you use BuildAI.
• Only request login links for customers who have just asked to open BuildAI from your panel, and never share, store or email them.
• Revenue share, perks and payouts are as agreed with us in writing and shown in your partner account. We may change them for the future with reasonable notice.
• We may suspend or end a partnership, or revoke API keys, if these terms are broken or to protect users. Accounts you created stay with your customers.

11. Changes and availability

We work to keep BuildAI running, but we can’t promise it will always be available or free of errors. We may improve, change or stop parts of the service. If we stop offering something you’ve paid for, we’ll give you reasonable notice and refund any credits you haven’t used.

We may update these terms. We’ll change the date at the top and, for significant changes, tell you by email or on the site before they apply. If you don’t agree, you can close your account.

12. Suspension and closing accounts

You can close your account at any time by emailing us. We may suspend or close accounts that break these terms, are used fraudulently, or put other users or our systems at risk. Where reasonable, we’ll tell you why first. If we close your account without you having broken these terms, we’ll refund your unused credits.

13. Our liability to you

We don’t exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breaking your legal rights as a consumer.

Otherwise, we’re not responsible for losses that weren’t reasonably foreseeable, for business losses (if you use BuildAI for business), or for loss of Minecraft world data you could have avoided with backups. Our total liability to you is limited to the amount you paid us in the 12 months before the claim.

14. Intellectual property

BuildAI, including the website, plugin, software and branding, belongs to us or our licensors. These terms don’t give you any rights to it except the licence in section 4 and the right to use the service. Minecraft is a trademark of Mojang Synergies AB.

15. General

• If a court finds part of these terms unenforceable, the rest still applies.
• If we don’t enforce a term straight away, we can still enforce it later.
• We may transfer our rights under these terms to someone else, and we’ll tell you if that affects you. You may not transfer yours.
• These terms are governed by the law of England and Wales. If you’re a consumer, you can bring claims in the courts of England and Wales, or of Scotland or Northern Ireland if you live there.
